PitchBox Terms of Service v1.0

By installing or using PitchBox, you agree to these Terms of Service. If you do not agree, uninstall the extension and do not use the service.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the PitchBox Chrome extension and associated backend services ("Service") provided by DivergeiX ("Company", "we", "us"). By installing, accessing, or using PitchBox, you ("User", "you") agree to be bound by these Terms.
2. Description of Service
PitchBox is a sales intelligence Chrome extension that:
- Analyzes publicly visible HTML source code of websites to detect technology signatures
- Extracts company-level metadata from public web pages
- Generates buying signals and outreach angles based on detected technologies
- Generates personalized outreach copy using our AI service
- Allows users to save and manage prospect records locally
3. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use PitchBox. By using the Service, you represent that you meet these requirements. PitchBox is designed for professional and business use.
4. Account Registration
- You may use basic features without an account
- An account is required for paid features (unlimited scans, prospect export)
- You are responsible for maintaining the confidentiality of your account credentials
- You must provide accurate information when creating an account
- You are responsible for all activity under your account
- Notify us immediately if you suspect unauthorized access to your account
5. Plans and Pricing
5.1 Free Plan
- 5 website scans per day
- 3 outreach draft generations per day
- Basic prospect saving (local storage)
5.2 Pro Plan
- Unlimited website scans
- Unlimited outreach draft generations
- Full prospect management and export
- Priority support
5.3 Payment Terms
- Pro plan requires a one-time or recurring payment processed through Razorpay
- Prices are listed in INR and may be updated with 30 days' notice
- All payments are non-refundable unless required by applicable law
- Razorpay's terms of service apply to all payment transactions
6. Acceptable Use
You agree to use PitchBox only for lawful business purposes. You must NOT:
- Use the Service to scrape personal data, private information, or data behind authentication
- Use the Service to harass, spam, or send unsolicited messages in violation of applicable laws (CAN-SPAM, GDPR, etc.)
- Reverse engineer, decompile, or disassemble the extension
- Attempt to circumvent usage limits, authentication, or payment requirements
- Use the Service to collect data for building competing products
- Share your account credentials with others or resell access
- Use the Service in any way that violates applicable laws or regulations
- Use the AI-generated content to impersonate others or create misleading communications
- Overload or disrupt our servers, backend services, or third-party APIs
7. AI-Powered Features
- PitchBox's outreach-generation, classification, and angle-generation features are powered by our integrated AI service. Access is included in your subscription — no external account or key is required.
- AI processing is subject to fair-use limits defined by your plan's daily and monthly caps. We may update these limits with 30 days' notice.
- AI output quality and availability depends on our infrastructure and third-party services. We do not guarantee specific response times or output content.
8. Intellectual Property
8.1 Our IP
PitchBox, including its code, design, detection algorithms, angle-mapping rules, and branding, is the intellectual property of DivergeiX. You are granted a limited, non-exclusive, non-transferable license to use the extension for its intended purpose.
8.2 Your Content
You retain ownership of any custom notes, saved prospects, and outreach copy you create using PitchBox. We do not claim any rights to content you generate.
8.3 AI-Generated Content
Outreach drafts generated by our AI service are provided for your use. You are responsible for reviewing, editing, and ensuring the accuracy and appropriateness of any AI-generated content before sending it to prospects.
9. Technology Detection Disclaimer
PitchBox detects technologies based on publicly visible HTML signatures. Detection results are provided on an "as-is" basis and may contain:
- False positives (detecting a technology that is not actually in use)
- False negatives (failing to detect a technology that is in use)
- Outdated information (technology may have been recently changed)
Detection results should be used as sales intelligence signals, not as definitive technical audits. Always verify critical information before relying on it.
10. Compliance and Responsible Use
10.1 Data Protection Laws
You are responsible for ensuring your use of PitchBox and any outreach you send complies with applicable data protection laws, including but not limited to:
- GDPR (General Data Protection Regulation - EU/EEA)
- CAN-SPAM Act (United States)
- CASL (Canada's Anti-Spam Legislation)
- IT Act (India)
- Any other applicable local, state, or national regulations
10.2 Outreach Responsibility
PitchBox generates outreach suggestions. You are solely responsible for:
- Reviewing all generated content before sending
- Ensuring messages comply with anti-spam laws
- Honoring unsubscribe requests and opt-outs
- Not misrepresenting yourself or your company
- Maintaining accurate sender information
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- PitchBox is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
- We do not guarantee the accuracy, completeness, or reliability of technology detections
- We are not liable for any damages arising from your use of the Service, including lost revenue, lost data, or business interruption
- Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
- We are not responsible for the content of outreach messages you send using PitchBox
- We are not responsible for third-party service outages (payment processors, AI infrastructure, cloud hosting)
12. Indemnification
You agree to indemnify and hold harmless DivergeiX, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Outreach messages you send using data or content from PitchBox
- Your violation of these Terms
- Your violation of any third-party rights or applicable laws
13. Termination
- You may stop using PitchBox at any time by uninstalling the extension
- You may delete your account by emailing support@divergeix.com
- We may suspend or terminate your account if you violate these Terms
- We may discontinue the Service with 30 days' notice
- Upon termination, your locally stored data remains on your device; server-side data is deleted within 30 days
14. Service Availability
We strive to keep PitchBox available at all times but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:
- Scheduled maintenance
- Third-party service outages (Chrome Web Store, AI infrastructure, cloud hosting, payment processors)
- Force majeure events
15. Modifications to Terms
We may modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance. For material changes, we will notify users through the extension or via email at least 14 days in advance.
16. Governing Law and Disputes
These Terms are governed by the laws of India. Any disputes shall be resolved through the courts of competent jurisdiction in India. Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for at least 30 days.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DivergeiX regarding PitchBox.
