These Terms of Service (“Terms”) govern your use of the Divergeix Email Analyzer Chrome Extension, website, and related services (collectively, the “Service”), operated by Divergeix Worldwide Private Limited (“Divergeix”, “we”, “our”, “us”), a company registered in Odisha, India (GSTIN 21AALCD8807G1ZP).

By installing, accessing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

The Service is a Chrome Extension that sends content from Gmail threads you actively open to an AI provider, and returns a summary, draft reply, or related output. Use of the Service is subject to a daily quota that depends on your plan.

2. Eligibility

You must be at least 18 years old.
You must have the legal authority to read the Gmail content you analyse (i.e., it must be your own account, or you are authorised by the account holder).
You must not use the Service for any unlawful purpose.

3. Your account

The Service uses a randomly generated user ID stored in your Chrome browser, optionally linked to your Chrome-profile email (with your permission). You are responsible for keeping your Chrome profile secure. If you uninstall the extension, your local data is lost; your paid plan is preserved on our servers if we have your email linked to it.

4. Plans and pricing

Plans are shown on our Pricing page:

Free — 3 emails/day, basic analysis only, 24-hour full-feature trial on install
Starter — ₹420 / month, 7 emails/day
Pro — ₹840 / month, 25 emails/day
Business — ₹1,430 / month, 50 emails/day

All listed prices are inclusive of 18% GST. A GST invoice is generated by Razorpay for every successful payment and sent to the email you provide at checkout.

We reserve the right to change plan prices or features with at least 15 days' notice to affected users. Existing paid-up subscriptions continue at their original price until the end of the current billing cycle.

5. Payment and billing

Payments are processed by Razorpay Software Private Limited. We never see or store your card or bank details.
Paid plans are billed monthly (or annually, if you choose annual) in advance.
You authorise Razorpay to auto-debit the subscription amount on each renewal date, in accordance with RBI e-mandate rules. You will receive a pre-debit notification 24 hours before each charge.
If a payment fails, we will retry per Razorpay's rules. If it ultimately fails, your plan will downgrade to Free until payment is made.

6. Cancellation and refunds

See our Cancellation Policy and Refund Policy for details. In short:

You can cancel any time. Cancellation stops future renewals.
Your current paid period continues until its end date; no partial refund on cancellation.
New subscribers have a 7-day refund window if the Service does not work as described.

7. Acceptable use

You agree not to:

Reverse-engineer, decompile, or attempt to extract the source code of the Service
Use the Service to process email content you are not authorised to read
Use the Service to generate spam, phishing, or fraudulent content
Share or resell your subscription
Automate calls to the Service or abuse the rate limits
Use the Service to train, benchmark, or compete against us

We may suspend or terminate accounts that violate these rules without refund.

8. Intellectual property

The Service, including the Chrome extension code, the backend server, and the branding, is owned by Divergeix. Outputs generated from your inputs (summaries, replies, etc.) belong to you. We grant you a non-exclusive, non-transferable licence to use the Service for the duration of your subscription.

9. AI outputs — accuracy

AI-generated text can be wrong, incomplete, or inappropriate for your specific context. You are responsible for reviewing every output before sending it, acting on it, or sharing it.

We do not guarantee the accuracy, completeness, or suitability of any AI output. The Service is provided "as is".

10. Availability

We target 99% monthly uptime but do not guarantee uninterrupted service. Maintenance windows, outages at our payment gateway, AI model provider, cloud hosting provider, or the Chrome browser platform, and force-majeure events may cause downtime.

11. Limitation of liability

To the maximum extent permitted by Indian law, our aggregate liability for any claim arising out of or related to the Service shall not exceed the amount you have paid us in the 3 months preceding the claim. We are not liable for indirect, consequential, incidental, special, or punitive damages (including lost business, lost data, or lost profits), even if advised of their possibility.

12. Indemnity

You agree to indemnify and hold Divergeix harmless against any claim arising out of (a) your misuse of the Service, (b) your breach of these Terms, or (c) your violation of any third party's rights, including intellectual-property or privacy rights, in the course of using the Service.

13. Termination

We may terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. In case of discontinuation, we will refund the unused portion of any prepaid annual subscription on a pro-rata basis.

14. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts at Bhubaneswar, Odisha.

15. Changes to these Terms

We may update these Terms. Material changes will be announced via the extension or the email linked to your account at least 15 days before they take effect. Continued use after a change means you accept the revised Terms.
